It's not like the government has some sort of illegeal music detecting virus/worm/spyware invading all computers. It's not that powerful...yet?

First you are not taking the only copy or a limited number of copys ie a compact disc, but it is still not legal in a copyright sense. And the making/not making some money from it. I think it sould be civil law not crime law, fines not prison time.

Well, some music is no longer (and never well be again) available on CD. That's my defense for some of my music downloaded.
