There's an old (still very fun) game called
Freedom Force. It was about a 1960s avengers style comic book hero team. The company that made it could not afford to license marvel or dc characters... So, they used pastiches of characters (i.e. Minute Man in place of Captain America etc...), but they also made the game easily moddable..
Soon there were thousands of free,fan made skins and models for marvel and dc comics characters...
All the skins and models were free, fair use items... But that did not stop the legal department at Marvel from harassing/intimidating everyone (including me) that was making and hosting marvel character skins and models... By contrast DC never bothered anyone for making and hosting skins/models.
Copyright infringement is in the eye of the be
holder, and it really depends on who owns the rights and how bored their legal department is....
