YouTube Copyright Scams
I just looked into my Videos and one of my WWF Attitude Videos has a copyright claim on it over the use of Marc Mero's theme. This time is different as the claimer is AdShare. They're a group who places copyrights mostly on video game videos by other people and makes money off of them AND THEY DON'T OWN SQUAT of the video. I've dealt with something like this before but now this time is different as well.
The disputes are as follows:
-I own the CD / DVD or bought the song online.
-I'm not selling the video or making any money from it.
-I gave credit in the video.
-The video is my original content and I own all of the rights to it.
-I have a license or written permission from the proper rights holder to use this material.
-My use of the content meets the legal requirements for fair use or fair dealing under applicable copyright laws.
-The content is in the public domain or is not eligible for copyright protection.

None of that applies to the situation. Even worse when I try to pick one and continue, there's usually a fill out a brief description and an electronic signature and stuff but that's all gone now. I don't know what to do. I don't want to spend every day deleting videos and re-uploading them when I should be preparing for other projects! Delete, Re-Upload, Delete, Re-Upload, and no progress is being made just one step back and one step forward over and over. I can't keep doing this. It's not even 3 days since my last Re-Upload.
So what should I do now? I'm curious what's to happen if I acknowledge it. I've never gotten an answer about it. Will I get a Strike? Will my Copyright ID Matches hit yellow?

Owning a CD or DVD does not give you rights to redistribute the content.
Whether or not you are making a profit does not change whether you are copying it (it is called COPYright, not PROFITright)
Giving credit does not mean you received permission to redistribute the content.
For it to be your original content, you must have filmed, drawn, or composed it, not just edited the video.
Do you really have a redistribute the content, or just a license to watch it?
Fair use means educational (in a classroom)(it is extremely narrow circumstances under which WWF videos would be educational), Editorial, or reporting a newsworthy event (again extremely unlikely with WWF contemt)
It is extremely unlikely that anything from WWF/WWE is in the public domain; it is not old enough for copyright to expire.
It is very likely that you have violated somebody's copyright. The question then is is this AdShare company the correct rightsholder, either the originator of the content or an agent of them? That I cannot answer. Probably you need to contact WWF/WWE and get written permission to use the content the way you have, then you'd have proof AdShare is trying to extort you.
I looked up AdShare. They actually HAVE a YouTube channel! They have a video about how their operations work. Once again, I MUST delete, rerecord, cut up, compress, and re-upload the video. I gotta do this for ALL of my WWF N64 video game videos until none of them show any music playing! That's BULLS(bleep)T!! ! At this rate, I'll be too busy to focus on future video projects. I feel like one of those empires that grew too large and too weak that it's starting to fall. I can only hope something forces me to close my YouTube channel and start over.

I don't have the money nor the equipment to do that. Video Games are all I have. If you're gonna start pestering me about this, then leave me alone.

If it's just a Let's Play (basically like a video walkthrough with commentary), then uploading videos of himself playing a game is not the same thing as uploading the game itself for other people to pirate. They can of course claim copyright over the cutscenes and music but most game companies that I know about usually allow Let's Play content because they see it as free advertising. For example, Blizzard specifically allows it and most other game developers allow it unless person is part of a closed beta testing group and they are under a non-disclosure agreement. I've seen a lot of Let's Players on Youtube but they don't often receive copyright claims.

I often wonder why people copy or sample other people's work and then try to claim it as their own.
There was an incident a few years back of someone posting XKCD comics with modified dialog, and then claiming that it was his own original work. He became indignant when several of us called him out on it, and claimed that because the idea for the new dialog was his, then the whole work was his as well. He was wrong on all counts.

I do have other games but most of them have been recorded already. There are other games mostly handheld ones I've considered Let's Playing but some of them emulate terribly to the point where they freeze. I was going to surprise viewers with a let's play where I didn't have to use cheats. I was going to try the original Turok trilogy but Dinosaur Hunter freezes in the middle of Level 3. Seeing as how I like working in chronological order, I scrapped plans for Seeds of Evil and Turok 3. I have games for xbox but I don't know if the Xbox emulator will work knowing the PS1 and Gamecube didn't. Every other game I know I've played, I've never beaten. I did have a Game Genie but I was young and didn't know how to use it and looking at cheats then vs now, most of the cheats then were kind of useless. I cheat on video games and I'm proud of it. My Let's Play list is incredibly thin. I haven't even finished my last one due to low motivation.

I'm not really doing that. I'm just playing video games I had growing up and some I should have had growing up. I, then, "claim" how much I enjoyed the games over the years and thank the companies for their hard work as well as the fact that we took them for granted (assuming the companies are defunct) and I encourage others to get their hands on a copy if they still have a working system because the Roms are not always 100% the same.
