There are a few sites like Home of the Underdogs, where they'll upload games on faith, and then take them down if devs/publishers/lawyers contact them. A lot of companies don't care though, or even give their blessings, but the bigger companies are pretty strict about that sort of thing (like EA or Activision). Even if the original devs are totally okay with it and wish to make their games freeware (or a similar license), it's often that the publisher still holds the rights and won't give it up.
Its how I view it anyways. The Publishers are the real problem, not the developers. Its why when it comes to free games I tend to support a lot of the stuff I tend to. Its either self-published, or I go the underhanded route when it pertains to the big fish such as EA and Activision (two companies I definitely refuse to support. Its yet another reason why I refuse to buy a Call of Duty or Battlefield game.
As for a lot of truly free games, a lot of them accept donations, so if its truly legit and not a scam I tend to toss them some money in support. I will also advertise by word of mouth. Hence why you tend to see me talking bout "Tale of the drunken paladin" on here quite often.
