That's actually not true, they don't lower the prices on games that are still selling.
Right now you can buy the Nintendo's newest SRPG a Code Name: S.T.E.A.M (3DS) at retail at decent mark down and the game released in 4 months ago.
Obviously the game bombed and retailers are liquidating them.
You can many Nintendo Wii U games at mark down at retailers, including The Wonderful 101 (less than $20 in most places), Bayonetta 2 and others that failed to sell well.
So yeah you can buy Nintendo games on liquidation and regularly on sale too.
I've bought plenty of 1st and 2nd party Nintendo games at discount since DS launched.
Though Nintendo and The Pokemon Company go to great lengths to prevent ROM and Emulator downloads, so it isn't worth the trouble (most gaming companies are doing it now).
You can find new and used copies of White 2 ranging from $15 - $35 (full price).
