That is a logical fallacy. It is not marriage that is protecting your rights, there may be legal idea in marriage law that could be theoretically protecting some rights. It not as it it would be possible to do without.

What is blaring obvious is single parents and unmarried couples do not get some of the right and privileges as married people do. On the other hand there are disincentives, it is just not want the average engaged couple think about.
