Judge rules against Rockland County's state of emergency over measles outbreak

A judge has ruled on behalf of several dozen parents who challenged Rockland County's emergency order banning children from public places unless they've been vaccinated against measles.

A state Supreme Court judge made the ruling Friday on the legality of Rockland County Executive Ed Day's order, which is part of efforts to stop a measles outbreak that has infected more than 160 people since October.

The lawsuit was filed by civil rights lawyer Michael Sussman on behalf of parents of unvaccinated students at Green Meadow Waldorf School in Chestnut Ridge. Sussman called Day's action "arbitrary and capricious."

The judge granted a temporary injunction, which for the time being, will end the state of emergency. This means unvaccinated children will once again be allowed to go to school and out in public.

The judge said such emergency orders cannot exceed five days. He also noted that 166 measles cases in a population of 330,000 people over six months doesn't constitute an "epidemic" meriting an emergency declaration.

New York City declares health emergency over measles outbreak in Brooklyn

"Since then, there have been additional people from Brooklyn and Queens who were unvaccinated and acquired measles while in Israel," the health department said.

It is science that is behind the development and success of vaccinations.

The failure to vaccinate is more common in people who consciously decided not to vaccinate for selfish reasons and not due to religious practice.

The Health Department, like infectious disease, is an equal opportunity service provider.

That in itself is a big red flag about these vaccines. If the 95% or so of people that got vaccinated can still be infected by the 5% that didn't, then what good is the vaccine?

I'm for people having their rights protected. But if what you are doing is a potential threat to others who are vulnerable for any reason, at this point one does have to outweigh the other. It's selfish and stupid to gravely endanger others for something that should've been eradicated since the 60's, if I'm not mistaken.

False Assumption. Those who get vaccinated do not get the disease, and that's the whole idea -- vaccinate as many people as possible to reduce or eliminate the occurrence of the disease.

It's the one person who gets infected, and who then infects the 5% who were never vaccinated, that is the problem. If the City of New York has 8,175,000 people, then a 5% infection rate means that 408,750 people in New York get infected.

And it's not just New York, but the rest of the country, as well. out of 327,200,000 people, a 5% infection rate means that 16,360,000 people get infected with a disease that should have been eradicated 50 years ago!

All because ignorant and gullible people believe the ravings of a discredited former doctor and a soft-core porn queen.

it's more a religious issue with the Hasidim/ultra-Orthodox Jews than with "anti-vaxxers."

Most of the measles outbreak---both in NYC and in Rockland county---is confined to the Hasidic/ultra-Orthodox community.

New York City issues fines of $1,000 to 3 people who refused to be vaccinated against measles

New York City followed through on its threat to fine people who refused to get measles vaccines on Thursday.

The city's health department issued civil summons to three people a week after issuing an emergency order requiring anyone 6 months or older who lived in four specific zip codes -- all in Brooklyn -- to get the measles, mumps and rubella (MMR) vaccine within 48 hours. Each person will be on the hook for a $1,000 fine.

In addition to the three people fined for being unvaccinated, the city also closed four additional schools for failure to provide vaccination and attendance records, the city said.

The health department had ordered United Talmudical Academy, a yeshiva preschool, closed on Tuesday, but it has now been allowed to reopen.

As of Thursday, there had been 359 measles cases in Queens and Brooklyn since the beginning of the outbreak last October, including 74 since the emergency order was issued on April 9.

"The initial child with measles was unvaccinated and acquired measles on a visit to Israel, where a large outbreak of the disease is occurring," according to the health department. "Since then, there have been additional people from Brooklyn and Queens who were unvaccinated and acquired measles while in Israel."
