I was watching this story at the gym, the 911 call went 'some idiot is driving crazy near a high-school where there are kids'

Was the guy drunk when he decided to drive mad like this?

I don't think he was drunk, but he's supposed to undergo a psychological evaluation by doctors.

There's no death penalty in Massachusetts. Even if this state did, the teen cannot receive it for the reckless driving he did.

He was probably some drunk-ass redneck who had had a few and couldn't resist leaving a few donuts in the astroturf... I know the type.

People usually don't get murder 1 when the crime is committed with a car. So even if he had run somebody over it would probably have been manslaughter.
