Weird, I'm sure there's a lot of legal significance to all this, and like many things of strictly legal significance, it doesn't make practical sense. What makes a data file "used"? One may as well declare a .doc or .pdf used.

Funny. BUT...

Every digital file ever created can be extracted for free from this easily computable irrational binary number:
0.11011100101110111100010011010101111001101111011111000010001...
(which is approximately 0.86224012586805 in decimal)
No digital file has ever been nor will ever be made that cannot be found in that number.

This is why I don't need, nor never even wanted, to own an iPod.

Simple arithmetic (in binary). Why? Because:

All files are strings of 0's and 1's.
All strings of 0's and 1's are binary numbers.
Therefore all files are binary numbers.

I think this was obvious to ALL computer geeks before Windows.

Unless you're leaving a step out, that seems rather similar to saying that you never need to buy another book, because you can sing the Alphabet Song, and all words (and thus all books) are implicit in the structure of the alphabet.

If you have Satellite Radio and understand the AHRA and you are in it's jurisdiction then you can legally (AHRA) fill up your mp3 player with mp3's for free. It basically says you can copy music from the radio for personal use.

I finally read the OP link to the article about "used MP3's".
Although it sounds valid by the "First Sale" copy right,
and doesn't allow you to sell an MP3 more than once,
it's fishy that you can't buy used MP3's (only new ones),
so maybe it is just for finding out what music you have.

Why else would they buy "used" ones and not sell "used" ones?
