The age to purchase tobacco is 18 or 19, depending on the state. Alabama and Florida, it is illegal for them to even possess tobacco. I think it would be be very unlikely the charges would be dropped.
Pennsylvania law requires you to be 21 in order to purchase cigarettes, and you must show legal ID in order to purchase tobacco products. Ditto for Alcoholic drinks.
