Is this fair?
According to the Americans with Disability Act the company must make REASONABLE accommodations for her disability. It is reasonable that she do not work at one station in the entire store. I mean its the one place where she could seriously injure or kill herself. She need only to remind them of her condition and then file a formal complain and if the problem persists she can legally sue the crap out of them. If she is fired after the complaint with the main office. It will only strengthen her case if they fire her because they retaliated against her unlawfully.
Oh and the hire up you file the complaint the better. It really burns their backside if they knew about such a serious issue and failed to resolve it.
1. Sounds like she's trying to get you to quit.
2. If you get a note telling them of your restriction, document them getting it. If nothing happens, file a complaint with whomever is their superior and file it as a complaint based on failure to accommodate under the ADA. Those who have done this route can better suggest how to best to that step, but once you officially file a complaint, they can't fire you without a very jaded eye looking at it as retaliation for filing a complaint. Yeah, they could still fire you for not being able to do your job or for doing something wrong, but it will automatically be suspect. I doubt the higher-ups have an issue with you having duty restrictions because of AS....there's so much you can do that it shouldn't matter.
