He took on an eighth grader? How old is your son? If he is way smaller and younger than this bully, why on earth is he being punished for preserving himself from harm?Find out what punishment the bully got and ask for the report and punishments in writing....If the bully got away and your son was punished, retain a lawyer and go after the school for discrimination based on disability, and negligence..
Also press criminal harassment and assault charges against the bully...He is old enough to be tried criminally .Given the circumstances, the court wont go after your son.Courts usually weigh in the age difference and size of the victim and offender.At least in the criminal code of canada, a person has a right to use reasonable force to defend themselves.My criminal law instructor even said, if a person is smaller than their attacker, they are justified in even using a WEAPON to defend themselves.Your son did not even use a weapon so he should not even be given a reprimand.
Nothing is going to get resolved in the Principals office..so you might have to start resolving it in a court room.
THE KID WHO BULLIED YOUR SON IS A CRIMINAL AND SHOULD BE TREATED AS SUCH.
