1)...The Question?....
"Have you had any weird legal dealings
or issues?"

2)...Statements by Ghosthunter!

Oh! Well! Just when things fall into place, another
intriguing retrospective of San Francisco emerges.
First, labor boards and 3 day notices, life's daily
struggles, and now Banner Waving violations!

Hmmm? Most intriguiging indeed. Remember
last week when I said Mrs.Police officer told
me about obstructing the sidewalk being the
only possible issue of banner waving? Well!
that just the beginning of learning about San
Francisco's district laws.

Just as a recap of last weeks interesting episode
of banner waving issues and S.F law, the
owner of the Subway across the street came to
me last week and asked me to move, and I
was scaring away his business.

The reason I wave the sign there is because
my employer was in that area first and the
Subway was hurting her business. She's been
there 5 years, the Subways been there for say
1 or 2 years.

I tell Mr.Subway owner I am just doing my job.
My employer is down the street. I am later
visited by Mrs.Police Officer and she couldn't
find any offense other that if I were obstructing
traffic and it's flow of...! She also said that
she will do some homework on this topic.

I return to my employer and she explains that
he wanted me to stop waving the sign in front
of his business area. He and her have
disagreements on this. He returned to his
store and henceforth I am visited by Mrs.Police
Officer.

A week will pass with no incident as I wave my
sign on Montgomery instead. I am being
a good boy not to obstruct traffic and
all is well.

Today, I am asked to ask the police station
about the laws of banner wagging. I am
told by the young officer at 10am that all
he can see wrong is traffic obstruction.

I now return to my Subway area to wiggle
and waggle my sign, and low-and-behold
Mr.Subway owner calls Mr.Officer. And I
am being the good boy I am stay in a
unobstructive area and wiggle and waggle
my sign.

Mr.Officer tells me I warned last week. And
I explain that Mrs.Officer last week said unless
I was obstructing traffic there was nothing
she could do. He produces a paper that
Mr.Subway owner had that came from Mrs.
Officer. I stated that in the Main District
(apparently Kearney area) didn't allow
street solicitation, including banner wagging.

Hmmm? I say I have done it on Montgomery
and had no incident. He say's just don't do
it in front of Subway. Am I in trouble? I ask?
No! he says but I have to write a infraction
ticket and you have to mail the fine. Hmmm?
How much is this fine? He didn't know and
suggested calling the Main District Police
station. I ask him for the paper so I can give
it to my boss. He said just call the Police
station.

I arrive back from banner wagging, and
the owners wife grills me a bit and said
she is going to fight this, and I did say
that Mr.Officer said there shouldn't be
any problems on Montgomery! Hmmmm?

Most Perplexed, in this current as the
Ghosthunter Turns legal edition?

That is interesting!

I've been seeing more and more of the banner waving in my area but never thought of the legal side of it!

I'm glad you personally were not in trouble. I think your employer should fight the ticket. You were told it was okay!

PS---GH, did you realize you posted this in the parent's forum? It would be read more in one of the general forums? Would you like it moved?

I have no clue where these pop
up at and if it can be moved, more
power to that! This is in regards to
moving this forum to general discussion.

Sincerely,
Ghosthunter

At 5:50pm, 5/12/05' I and the owners
wife went to the tenderloin police
station to get the young officers
name. It turns out that the help
desk is a rotating "No-Name" desk.

Thus without this officers name, I have
to still file for a court date. I will also
have to get fine cost information.
Hmmm?

This has 2 benefits.

1)...My boss wanted to know the
legalities of sign waving!

2)...If the ticket is tossed?
Subway has no recourse,
and I can say I had another
day in court, and can continue
waging the sign.

Hmmmm?More updates will come as
they come. 8am I am off at
the restraunt, and I go to The
850 Bryant Courthouse, and do
the following things. OH! UH!
I hate that place it makes everyone
feel like a criminal
BUT.....shows how much support
that the owner and his wife have for
me. They know I am autistic, and
let me handle large amounts of
cash because I am very honest,
and certain bookkeeping that only
a honest person would do! Like
payroll, ect.... :D :D

Sincererly,
Ghosthunter
