Okay this is way to harsh for a kid autistic or not!! ! Criminal charges is way to extreme!! ! I don't think he will even be able to understand that! I sure wouldn't have at that age!

That's the reaction that came from Velasquez after she heard her 7-year-old autistic son Noah could face battery charges for punching his teacher.

Velasquez said Noah was upset in class and was lying on the floor. According to Velasquez, when the teacher tried to pick him up by the arm, he hit her.

"In an autistic child, nobody knows how they think," said Velasquez. "This poor innocent child was traumatized by it."

Velasquez said Noah has a behavior plan that states when he's upset, he's not to be touched.

Franklin Elementary School Principal Haylee Ladow said she can't comment on specific cases, due to student privacy laws.

However, she said she knows the teacher handled the situation appropriately.

"We have policies and plans and procedures that we follow for our students to ensure their safety, as well as others," said Velasquez.

That is ABSOLUTELY WRONG! If the boy truly is with autism, and he punched for personal space invasion, it is a reflex and not an act of violence. Although I have always tried to control it, I cannot help it if someone comes up and taps me on the shoulder from behind... They're going to get my elbow in the ribs without my control. If someone were to try to grab or restrain me, I would stop them physically, and that's not something I can control. THEY can control if though... All it takes is to announce and explain first!! !! Then I'm OK with it. People just don't understand. I felt bad when I shoved a fireman who tried to escort me to sit on a bench to look at a minor injury I had from a fall from a roof, and that was before I knew about my place on the spectrum. I apologized profusely, but I also knew I could not have stopped myself in time from shoving him. It happened too fast.

Didn't I read somewhere that it was illegal not to put someone into special services just because it didn't effect their grades? ._.

Time to lawyer up. A good lawyer (and probably even a mediocre one) should be able to use the existence of his clinically diagnosed autism and the Behaviour Intervention Plan (apparently not followed by the teacher) to get the charges dropped. The school system should be paying for his alternative placement too. I hope a lawyer can get that as well.

And not cared for autistic traits at all, despite a diagnosis. I can't believe it. How can it be?

My thoughts exactly. Once, when my maternal grandmother had tapped my leg, in passing, I about kicked her into next week. :o It was simply an act of automatic reflex. I actually adored my grandmother, and would have never deliberately lashed out at her. We aspies just have hypersensitive nerves sometimes.

Is there not a minimum age of criminal responsibility in the US? In the UK it's 10.

This is ridiculous. No 5 year old (regardless of whether they have a disability or not) can understand something like this.

Apparently, there are still a lot of people who believe that Autism is an automatic "Get Out of Jail Free" card.

But a 7-year old facing battery charges? :roll: Must be a slow day on the docket.

Anyway, it's the parents that should be sued for damages, not the child.
