My son refused to go to class...he was sitting in the office. The school decided to have the police laison "escort" him back. When the officer grabbed D's arm, D fought resulting in a charge of assulting a police officer. (<--This is the abbridged verson, of course. I'll posted about this before...no need to do it again.)

His first court date is tomarrow. His attorney has informed us since this is a voilent crime charge, D will be taken into custody, lead away from us, fingerprinted, and then returned to us to wait until he is called. We've tried to prepare D for this. At a friends suggestion, I will also talk to the bailiff before D is brought in to explain that he has autism and SID and there for may act differently...that to keep things moving smoothly it would help to explain what was going to happen before actually starting.

If you're of the praying sort, I'd appreciate a prayer for us.

How awful, I can't imagine how to prepare your son for this! I wonder if your son could have a family companion because of his age and autism?? Good luck.

I'm not up to date on your son's situation. How old is he?

From what you say, this sounds like ... grade school. If that's the case, somebody needs to have his head examined. Who in his right grabs an autistic child?

Prosecuting him?

I feel like I'm living in some feudal society here...

Good luck with this. I'll certainly be sending a prayer your way.

I am agast!
I am also sending prayers your way.

It seems like that is something that should be in his BIP. Shame on your son's school.

OMG. this is ridiculous. they obviously don't like the kid and want to punish him further. I hope the judge sees that, and that the school is wasting the courts time with 'vexatious litigation'. I would certainly be putting that case. I s'pose there's no other school suitable?

BeeBee,

If you read this before court today, see if you or D's lawyer can find out if the prosecuting attorney received D's Special Education and Disipanary Records or not. I will explain later. My prayers are indeed with you and D.

GroovyDruid,

Unfortunately some courts do not work that way. In the area where BeeBee resides, the county and local police are known for overzealously enforcing small infractions such as speeding and code violations while an adult illegal immigrant can hide out in the High School without anyone knowing anything. D represents everything that the majority of the people in that area are afraid of and I am worried that the judge will simply follow form and throw the book at D.

Having read the "full text" version before, I can't believe they are considering this a *violent crime*! ! That is insane. And to lead a minor child away without a parent or guardian to be fingerprinted by people used to dealing with hardened criminals?? We can only hope he comes out of this little worse for the wear.

We are rooting for you, and for D. Please keep us posted.

So BeeBee, how did it go? I hope things went well. I have been thinking about you and D all day and wondering what kind of a country we live in where policemen grab autistic children who are melting down and then prosecute them when they hit back. I hope the judge has more sense.
