I was laid off from my job as a games tester at the start of 2022, and after being told this year that I couldn't attend a pride march through the city with them because I had apparently been blacklistedm I made a data subject access request from the company and the reason they gave for my lay off and blacklisting was "poor performance".

I've made a complaint against them explaining that I was frequently told by my leads that I was one of the highest performers on the team and have the performance reports and statements from other staff on the team to prove it, and told them that the only performance related issue I faced was due to an issue related to my autism where another member of staff complained about my poor communication skills just before I was laid off. They have naturally denied this.

Is there anything I can do to make a claim against them for disability discrimination ?

A employment lawyer would be better qualified to answer this question than any of us on here most likely. I would just get a consultation with a lawyer.

Also, it can vary from state to state.

Keep in mind that discrimination is usually only illegal if it is for certain forms such as race, color, religion, and so on.
