It's impact, sean.
The sonar
poses far less danger to the environment than a Chineese, or possibly someday a North Korean missile submarine would pose.
And a Navy without sonar or with a safer substitute poses even less danger than that of our present chief executive, whose reckless international cowboy act, coupled with environmental denial, provokes terrorism and other nations like China to upgrade their military for their own defense.
Such lawsuits have been sidestepped under the guise of National secuirity before, and I hope this one does too.
If the government could avoid paying up for wrongful deaths at Area 51 in the early to mid '90s, they will most likely cite that parts of the sonar system that would validate or disprove the claims of the lawsuit are classified and are important to National security, and the lawsuit will have to be thrown out since the plantiff will not have the evidence neede to prove their case.
You are probably right though the outcome you desire is wrong.
