A woman accused of tormenting her neighbours with her noisy love-making has appeared in court

Caroline Cartwright, 48, was remanded in custody until May 5 charged with three breaches of her Asbo in ten days.

Magistrates in Sunderland slapped her with a four-year order on April 17, banning her from "making excessive noise" anywhere in England.

But Houghton le Spring Magistrates' Court heard that police arrested her on April 18, April 22 and April 26 after neighbours complained she was flouting the ban with the help of husband Steve.

Prosecutor Claire Ward said there were complaints of early morning shouting, moaning, groaning and the sound of a bed banging against the wall. Cartwright was arrested on Sunday and charged with three counts of breaching her Asbo.

Cartwright, of Hall Road, Concord, Washington, Tyne and Wear, whose husband sat in the public gallery, elected trial by jury and her case will be transferred to Newcastle Crown Court.

A bail application from defence solicitor Peter Lothian was refused.

Cartwright was remanded in custody and ordered to appear via video link before Sunderland Magistrates' Court on May 5.

On April 17, she was convicted for five breaches of an abatement notice and fined a total of £515.

Magistrates also imposed the Asbo, banning her from making excessive noise, knocking, shouting, screaming or vocalisation that can be heard in neighbouring properties or outside the house, and playing loud music

Doesn't the British government realize that making all these laws which make it easier for people to file complaints about the slightest offense, will eventually turn into a big witch hunt (See: Colonial times in America)? They have no constitution, so they can warp the laws in any way they want, and change them whenever they see fit.

Why is it that people are quick to make assumptions about British law, based on sensationalist media reports?

Does anyone actually know the details of this case? This sort of case could happen anywhere, including the US without changing any laws either.

Ok you can accommodate your neighbour having a bit of noisy sex. People should have a good time right. Don't want to be a kill joy. However if people are purposely trying to harass you, causing noise and banging then you have rights too.

Get your facts straight first. We don't have a single written document. That doesn't mean we don't have conditionally binding documents. Also don't confuse government with judiciary, or Britain as a whole.

Stupid laws happen that is just a fact of life. Writing them into the constitution doesn't help. That just means they will probably be around for longer. Manifesto politics is stupid. Infallible constitutions are much more stupid. Because we all know because it is from the past it must be right :roll:

You should know that a bulk of the US system is based on the British system, and if they didn't hold it in high regard the American Bar Association would not have paid for a memorial to be built in Runnemede outside London with the inscription 'To commemorate Magna Carta, symbol of Freedom Under Law' and organise for scores of lawyers to come over each year.

If you are going to make a criticism come up with an actual argument or proposal. For instance I don't agree with the House of Lords now Lord Chief Justice, etc. I think it is important to have a second chamber though, an elected one. But I do think the High court need to be further separated. However I don't think the Supreme Court model is without its problems either. Both suffer from the aging judge’s problem, where they are waiting for each other to die. There should be more rotation in my opinion.

that already happens. The ASBOs in the UK have a reputation for being abused like that.

From what i've read in the paper, she's excessively loud EVERY day of the week, for HOURS on end. A good 10 - 20 million other people manage to have sex without pissing their neighbours off. I really don't see why you guys are taking an issue with this story. I'd agree that the british government is too "big brother" like, but this story isn't an example of that.

The american constitution has had 27 ammendments, and a further 6 have been tried. Hence your arguement is void. Additionally one of the 6 that was tried, was giving voting rights to residents of washington, DC. How on earth can you mock other governments when you don't even have universal suffrage.

Well in fairness "constitutional monarchy" fails if the queen can express he political opinion and vote. Even though there is no law against it.

The argument for "constitutional monarchy" is not far removed from saying "we need a head of state, why not a Chihuahua?"

that already happens. The ASBOs in the UK have a reputation for being abused like that.

ABSOs are amusing. There were intended mostly for young hoodlums. Except the 40+ group seem to be picking up a lot of them. Pensioners are one of the most hard core contingents.

My neighbor has a tendency to mow the lawn in a reall roud fashion, and the cars that continously come and go always honk when they leave. If I were British, could I make it so that he could never receive visitors or mow the lawn again?
