Can someone on the autism spectrum (specifically Asperger's) be considered to act the same as a "reasonably prudent person"? The legal term basically means how the average person, with general relevant knowledge, would act. Generally the standards are relaxed for children or those with physical disabilities (but oddly enough not those with mental illness), or raised for talented citizens in a related field (lawyers, doctors, etc). So where do folks with Asperger's stand? Are we normal enough to be be judged by the same standards as an average person?
"A reasonably prudent person is an individual who uses good judgment or common sense in handling practical matters. The actions of a person exercising common sense in a similar situation are the guide in determining whether an individual's actions were reasonable."
